Tennessee law establishes the following penalties.

  • Those convicted of boating under the influence will be sentenced to serve at least 48 consecutive hours in a county jail or workhouse for first offense. If the BAC is 0.20% or more on first offense, then a minimum of seven consecutive days shall be served. For a second offense, the sentence will be at least 45 consecutive days, and for a third offense, the sentence will be at least 120 consecutive days.
  • Those convicted a fourth or subsequent time will be sentenced as a felon and subject to punishment as such.
  • In addition, those convicted of BUI may lose operating privileges for one to ten years.
  • Federal penalties also may be imposed.
