Alabama law prohibits anyone from boating under the influence (BUI)—that is, operating any boat, sailboat, PWC, water skis, sailboard, or similar device while intoxicated due to alcohol or any combination of alcohol, controlled substances, or drugs. Alcohol and drugs cause impaired balance, blurred vision, poor coordination, impaired judgment, and slower reaction times. Alcohol is a major contributor to boating accidents and fatalities.

Alabama law specifically states that it is illegal to be in physical control of any vessel, water skis, or similar device if the operator:

  • Has a concentration of alcohol in his or her blood of 0.08% or more.
  • Is under the influence of:
    • Alcohol, any controlled substance, or drugs or...
    • Any combination of alcohol, controlled substances, or drugs or...
    • Any substance that impairs the operator's mental or physical faculties.
