Did You Know? Texas Supports Anglers with the State's Constitution

Did you know? Since November 2015, Texas officially enshrined hunting and fishing in the state constitution with the passage of Proposition 6.

Yes, that means Texans officially have the right to hunt, fish, and harvest wildlife in the state. Texans have always valued their rights to fish and hunt, and this change to the state constitution makes that a permanent part of Texas law.

While you still need a license to fish in Texas (and we always recommend taking a boater education course if you plan to fish from a boat), the law now protects your right to fish and hunt in Texas. 

Why Does Texas Need a Law? 

In the state constitution for Texas, Section 34 now says: 

"The people have the right to hunt, fish, and harvest wildlife, including by the use of traditional methods, subject to laws or regulations to conserve and manage wildlife and preserve the future of hunting and fishing."

So, was this change to the constitution really necessary for you to grab a fishing pole and spend a day catching fish? Maybe not, but the state's commitment to these activities by making them a "right" means you have a better guarantee that you'll never have to stop hunting or fishing if you live in Texas.

"To me, it is a better guarantee; [hunting, fishing, and the taking of wildlife] goes from a privilege to a right," said Steve Hall, Hunter Education Coordinator with Texas Parks and Wildlife. "We can put away our privileges, but we can't put away our rights."

Texas is Home to Many Hunters and Anglers

Even before this change to the constitution in Texas, the state had plenty of avid hunters and anglers. Since then, these activities have continued to be favorite pastimes in the state. 

In 2023, there were 1,170,316 licensed hunters. Texas also sells more than 2.7 million fishing licenses each year. 

That means hunting and fishing are also big business in the state, creating a significant economic impact and supporting a high volume of jobs.

By passing Proposition 6 and the other constitutional amendments, Texas residents "are creating an even better place for future generations to live, work, and raise a family," according to Texas Gov. Greg Abbott.

Do Other States Make Hunting and Fishing Part of Their Constitutions?

After the passage of Proposition 6, Texas joined at least 18 other states that have made hunting and fishing an important part of their constitutions. Imagine if every state prioritized hunting and fishing as a right for residents and protected it in their constitutions. 

When local and state governments understand the value of hunting and fishing and their impact on wildlife management, we protect our natural resources and promote ethical ways of providing food for our families. 

No Matter Where You Fish, Get Your Boater Safety Certification

While states like Texas protect your right to fish and hunt, it's up to you to stay safe while doing these activities – especially if you fish from a boat. Most states now require boaters to carry a boater safety certification, which helps keep people safe while on the water.
